Property Conveyancing:
Your Investment Protected
Buying or selling a property is probably the most important financial transaction of your life. But in the real estate market, going cheap can be expensive if you don't check the small print.
At Servinmosol, we are not just intermediaries; we act as your legal shield. We review charges, urban planning, and contracts so you can sign at the notary with the peace of mind that there will be no unpleasant surprises tomorrow.
We have seen cases of homes with 5-year IBI debts, unregistered illegal extensions, or hidden embargoes. If you sign without checking, the debt becomes yours. We prevent that from happening.
For the BUYER: Legal Audit (Due Diligence)
Before you pay a single euro for a reservation, our legal team carries out a thorough investigation of the property:
- Registry Verification (Nota Simple):
We check who the true owner is and if there are mortgages, embargoes, or rights of way.
- Urban Planning Check:
We confirm that the property has no urban infraction files at the Town Hall and has a valid Habitability Certificate.
- Community Debt Certificate:
We require the estate administrator to provide a "zero debt" certificate so you don't inherit the previous neighbor's levies.
For the SELLER: Comprehensive Management
Selling is not just handing over the keys. We help you prepare the perfect sales dossier so you don't lose buyers due to missing paperwork:
Mandatory processing before advertising the house.
We calculate the Municipal Plusvalía and capital gains tax before selling, so you know the real net profit.
We manage the zero-debt certificate with your bank and its registry cancellation.
The Deposit Contract
We draft a tailor-made Penitential Deposit Contract. This document is vital: it locks in the price and the signing date.
If the seller backs out, they must return double the amount. If you back out, you lose the deposit. No generic internet templates; we draft clauses that protect your specific interests.
Signing Day (Notary)
You won't go alone. We accompany you to the notary to:
- Review the draft of the Public Deed before signing.
- Act as translators if you do not master the legal language.
- Manage payments through banker's drafts or OMF transfers.
- Settle taxes (ITP or VAT) and register the house in your name at the Land Registry immediately after.
Once you have the keys, we don't leave. We carry out the change of ownership for electricity, water, and garbage tax (SUMA) so that you arrive at your new home and only have to turn on the switch.
